Welcome to Tonga Booking. By accessing or using our platform, you agree to be bound by these Terms & Conditions (“Terms”). Please read them carefully. If you do not agree, do not use our services.

1. Definitions

• “Platform” refers to Tonga Booking, including website, mobile app, and related services.

• “User” / “You” means any person or entity using the platform.

• “Service Providers” means hotels, property owners, car rental agencies, boat operators, tour providers, event organizers, flight operators, and space service providers listed on the platform.

• “Bookings” means reservations made through the platform.

2. Scope of Service

• The platform acts as a booking intermediary. We provide a marketplace connecting Users with Service Providers.

• We do not own, operate, or control the services provided (hotels, cars, boats, tours, events, flights, space bookings).

• All bookings are contracts between the User and the Service Provider.

3. User Responsibilities

By using our platform, you agree to:

• Provide accurate and complete information when making a booking.

• Be at least 18 years old or have legal capacity to enter into contracts.

• Comply with all laws and regulations related to your booking (e.g., travel, safety, customs).

• Use the platform only for legitimate bookings, not fraudulent or speculative purposes.

4. Platform Responsibilities & Limitations

• We facilitate bookings but do not guarantee the quality, safety, legality, or availability of services offered by Service Providers.

• We are not liable for delays, cancellations, accidents, damages, losses, or issues caused by Service Providers or Users.

• We make reasonable efforts to ensure the platform is accurate and secure but do not guarantee error-free or uninterrupted operation.

5. Payments & Fees

• All payments are processed securely through approved payment providers.

• Users agree to pay the full price displayed at the time of booking.

• The platform may charge service or transaction fees. These are non-refundable unless stated otherwise.

• Refunds (if applicable) are subject to the cancellation policy of the Service Provider.

6. Cancellations & Refunds

• Each Service Provider sets their own cancellation and refund policies.

• Users are responsible for reviewing these policies before booking.

• The platform is not responsible for refunds unless explicitly stated.

7. Reviews & User Content

• Users may leave reviews and feedback, provided they are truthful and not misleading.

• We reserve the right to remove or moderate content that is abusive, fraudulent, or violates these Terms.

• By posting content, you grant the platform a worldwide, royalty-free license to use, display, and distribute it.

8. Intellectual Property

• All platform content (design, branding, software, etc.) is owned by or licensed to us.

• Users may not copy, distribute, or misuse platform content without permission.

9. Liability Disclaimer

• The platform is provided “as is” without warranties of any kind.

• We disclaim all liability for direct, indirect, incidental, or consequential damages arising from:

  • Service Provider actions, errors, or failures.

  • Cancellations, overbookings, strikes, force majeure events, or unforeseen circumstances.

  • User misuse or violation of these Terms.

10. Indemnification

You agree to indemnify and hold harmless the platform, its owners, employees, and partners against any claims, damages, or expenses arising from your:

• Use of the platform.

• Violation of these Terms.

• Interaction with Service Providers.

11. Governing Law & Dispute Resolution

• These Terms are governed by the laws of Tonga.

• Any disputes shall first attempt to be resolved amicably. If unresolved, they will be subject to the courts of Tonga.

12. Termination

• We reserve the right to suspend or terminate accounts at our discretion for violation of these Terms, fraud, or misuse.

• Users may stop using the platform at any time, but obligations under bookings remain binding.

13. Changes to Terms

We may update these Terms at any time. Changes will take effect immediately upon posting. Continued use of the platform means you accept the updated Terms.
